having lifted the reservation made in the proceedings indicated in the heading,

has issued the following 

ORDER

FOR THESE REASONS

Enjoins Parijan Sas from using the Loro Piana and White Sole trademarks in its business activity; 

Enjoins Parijan Sas from manufacturing and marketing the products Monaco Old Money Suede Loafers, Old Money Premium Suede Loafers and High Suede Loafers; 

Orders Parijan Sas to pay the sum of €1,000.00 for each day of delay in complying with this order, with effect from the seventh day following its notification; 

Imposes on Parijan Sas a fine of €500.00 for each item placed on the market in breach of the injunction; 

Orders the publication, for a period of three months, of the heading and operative part of this order on the home page of Parijan Sas’ official website, including in English, in a clearly visible position and without the possibility of redirection via a link; 

Orders Parijan Sas to reimburse Loro Piana Spa for the costs of the proceedings, which amount to €4,227.00 for legal and Court fees, service costs, a flat-rate sum of 15% for general expenses, Bar Contribution and VAT.

sciogliendo la riserva assunta nella causa in intestazione, 

ha pronunciato la presente

ORDINANZA

Inibisce a Parijan Sas l’uso nell’attività economica dei segni Loro Piana e White Sole; 

Inibisce a Parijan Sas la fabbricazione e il commercio dei prodotti Monaco Old Money Suede Loafers, Old Money Premium Suede Loafers e High Suede Loafers; 

Fissa a carico di Parijan Sas la somma di € 1.000,00 per ogni giorno di ritardo nell’esecuzione del presente provvedimento, con decorrenza dal settimo giorno successivo alla sua comunicazione; 

Fissa a carico di Parijan Sas la somma di € 500,00 per ogni cosa messa in commercio in violazione dell’inibitoria; 

Ordina la pubblicazione per un periodo di tre mesi dell’intestazione e del dispositivo della presente ordinanza sulla home page del sito internet ufficiale di Parijan Sas, anche in lingua inglese, in posizione chiaramente visibile e senza possibilità di rinvio tramite link; 

Condanna Parijan Sas a rimborsare alla Loro Piana Spa le spese di lite, che liquida in €4.227,00 per compenso, oltre contributo unificato, spese della notificazione, spese forfettarie nella misura del 15%, Cpa e Iva.
